Scottish Natural Heritage Grant Programme - Standard Conditions attached to all grants
- SNH's contribution must be acknowledged in all publicity about the scheme or any reports produced as part of it. Where relevant, payment may be withheld until any evidence as may be required by SNH in accordance with Standard Condition 6 below, is submitted to confirm that this condition is being, or has been, adhered to.
- The cost of any work carried out, or equipment purchased, before the applicant has accepted the offer will not be eligible for grant, unless this is agreed in writing with SNH.
- The applicant must comply with all relevant domestic and European legislation and shall have the consent of any other person or body with an interest in the scheme, or the site of the scheme, before work commences. Evidence of compliance and consents must be supplied to SNH if requested.
- SNH will not fund any increase in eligible costs, unless these have been agreed in writing beforehand.
- Unless specified otherwise in the offer letter, grant will only be paid after work has been completed and a claim received by SNH.
- SNH reserves the right to request additional supporting evidence of expenditure or acknowledgement e.g. receipted invoices, payslips, time sheets, press releases or publications etc.
- The offer of grant is made on the understanding that the applicant will have disclosed to SNH any financial contributions received or expected for the same purpose from any other body financed from public funds. If any such contributions have not been disclosed, SNH may vary or cancel its offer to take account of them.
- The grant must be used for the purposes and in the manner set out in the application.
- The applicant is responsible for maintaining any works or equipment which are the product of this grant scheme, for the period specified in Clause 18.
- The applicant shall be responsible for restoring or replacing any facilities which are the product of this grant scheme which may be damaged or lost through fire, theft, accident, storm, flood or malicious damage during the period specified in Clause 18, unless SNH specifically agrees otherwise.
- The applicant should provide SNH with prior notification of any proposal to sell or dispose of any equipment or works which are the product of this grant scheme, or of the land on which they are situated during the period of this grant offer. In the event of such sale or disposal, the grant, or such part of it as SNH thinks fit, shall be immediately repayable to SNH in accordance with Condition 13.
- In the event of the following, the applicant shall be bound to repay to SNH on demand the full grant, or such part as SNH thinks fit, in accordance with Condition 13:
1.Breach of any of the terms and conditions of this offer of grant.
2. Any information given to SNH by, or on behalf of, the applicant in connection with the payment of the grant, is found to be false or misleading, whether this is provided before or after the grant has been paid.
3. Any failure, delay or omission by SNH to exercise any right to demand repayment shall not be construed as a waiver of such right.
4. Without prejudice to the foregoing provisions of this Condition 12, if any of the events specified in Condition 12.1 or 12.2 occur prior to the grant, or any part or instalment, being paid to the applicant by SNH, then SNH shall be under no obligation to pay the grant or the remaining balance, as the case may be, to the applicant and the applicant shall be deemed to have forfeited all claims and rights to same.
- Where the grant or any part of it is repayable to SNH in terms of these Conditions, the amount payable shall be the total amount of grant paid, but, except in the case of Condition 12.2 above, reduced by equal proportions over the whole of the grant period so that by the end of that period the liability for any repayment would be nil. Interest shall be payable on the amount of grant repayable, at the prevailing treasury interest rate, from the date on which the repayment is due until it is made.
- The applicant shall indemnify SNH against all action, claims, demands, costs, expenses and losses incurred by or made against SNH which arise out of or in connection with the payment of the grant by SNH or any facilities, services or others created or provided using the grant.
- Any person authorised by SNH on its behalf shall be entitled to inspect the grant scheme, at all reasonable times, for the purpose of ensuring that the terms and conditions of this grant offer are being complied with.
- SNH reserve the right to publicise full details of any grant offered including name of recipient, project details and grant offered.
- Any letter, notice or demand by SNH shall be sufficiently served on the applicant if it is delivered by hand or left at the applicant’s last known address or sent by post addressed to the applicant at that last known address.
- The terms and conditions applying to this scheme will apply for a period of * year(s) from the date of final payment of grant.
