Whale, Dolphin, Porpoise and Basking Shark
In British waters it is an offence to:
- kill, injure, or capture these animals;
- intentionally or recklessly disturb or harass them.
All species of whale, dolphin and porpoise (collectively known as cetaceans), and the basking shark, are protected and it is an offence to kill, injure or capture them. It is also not permitted to intentionally or recklessly disturb or harass them. The Scottish Marine Wildlife Watching Code provides guidance to those wishing to observe cetaceans, basking sharks and other marine wildlife. The Scottish Executive has a comprehensive online guide to legislation on marine mammals.
