Badgers
Badgers and their setts are comprehensively protected by the Protection of Badgers Act 1992.
It is a crime:
- disturb a badger while it is occupying a sett;
- to wilfully kill, injure, take or attempt to kill, injure or take a badger;
- to possess a dead badger or any part of a badger;
- to cruelly ill-treat a badger;
- to use badger tongs in the course of killing,taking or attempting to kill a badger;
- to dig for a badger;
- to sell or offer for sale or control any live badger;
- to mark, tag or ring a badger;
- disturb a badger while it is occupying a sett.
It is also a crime to interfere with a badger sett by:
- damaging any part of it;
- destroying it;
- obstructing access to it;
- causing a dog to enter it.
A badger sett is defined in law as any structure or place which
displays signs of current use by a badger. You may only interfere with a
badger sett if you have a personal licence issued by SNH or the
Scottish Executive.
